What WHS Compliance Requires

Under the Work Health and Safety Act 2011 (WHS Act) and equivalent state legislation, every PCBU must, so far as is reasonably practicable:

• Provide and maintain a work environment that is without risks to health and safety
• Provide safe systems of work, including documented procedures and policies
• Ensure safe use, handling, and storage of plant, structures, and substances
• Provide adequate facilities for the welfare of workers
• Provide information, training, instruction, and supervision to workers
• Monitor the health of workers and workplace conditions
• Consult with workers on matters that affect their health and safety

Why Ongoing Compliance Matters

SafeWork inspectors can visit your workplace without notice. They examine your WHS documentation, consult your workers, and assess whether your controls are adequate and up to date. A compliance check done once — and then filed away — does not demonstrate the ongoing due diligence required by law.

WHS compliance requires a living system: hazard registers updated as conditions change, incident investigations completed and acted upon, training records current, and evidence of regular review. This is what regulators look for.
